Can't Get a Court Date? Don't Blame Your Attorney
Every good lawyer knows that there are some things you ask him fired or brought before the bar of Florida with a complaint faster than miss a deadline or not to return phone calls or emails.
However, even the most ethical lawyers face every day with angry customers because we can not get a hearing or trial before a judge please fast enough for our customers. A mother decides that she will not allow a father to see their children more, and it takes a month or more for a judge to rule on the question.An owner wants to evict a tenant and the landlord must wait another two months before a judge will be a trial. A bank wants to lock onto a piece of property and must wait an average of 18 months for a trial.
Lawyers are, unfortunately, accustomed to the deadline. Customers are not. This is especially true in a world where instant gratification is the norm. Sometimes it is the fault of the lawyer. In most cases it is not, and it is beyond their control.
In a day when the public expects instant results, but the government lacks the resources to provide services to the public, it is not the fault of the court and not counsel's fault.
Your local registrar of the Court staff shortages and overworked. Employees who used to make the justice system operates at respectable, were removed. I can assure you that I practiced in Pinellas County and the clerk of the Circuit Court, the Honorable Ken Burke, working hard to do what it can with available resources.
I personally met with Burke and is diligently trying to implement and improve programs so that citizens can have a better and more effective experience in the judicial system.
Unfortunately, access and efficiency of the judicial system will not improve until our elected officials appropriate the funds necessary for the court to allow this essential branch of government to function effectively. In fact, in 2010, the Florida Supreme Court affirmatively recognized that the current economic situation has hampered our justice system.
